USING A LEASE OPTION (RENT-TO-OWN)


STEP 1: Set the Lease Period

We will lease your house for a certain amount of time. Generally, most contracts last one to three years.

STEP 2: Determine the Amount of Rent

Decide how much of the monthly rent you want to apply to the purchase price. This is called the “rent credit.” For example, you can decide that 50% of the rent will be applied as a down payment. If the tenant pays $1,000 in rent for three years, then $500 a month for 36 months ($18,000) will be applied. You could also hire an escrow company. The company would receive our rent payments, then use them to pay your mortgage, taxes, and insurance. A property management company could also handle these transactions.

STEP 3: State the Security Deposit

Identify how much money you want from us as a security deposit. Also explain what you can use the security deposit for, such as to repair any damage to the property. Additionally, we (SOLID Vestments LLC) will forfeit any deposit if we break some provision in the lease.

STEP 4: Set The Deadline

The option usually begins when the lease agreement is signed and ends when the lease agreement expires but you can also grant extensions for extra cash.

STEP 5: Choose the Purchase Price

Your contract will explain how you will determine the purchase price of the home. We can agree on the purchase price when we sign the contract.

STEP 6: Assign Responsibilities for Maintenance

During the lease, your house might need repairs. If you want us (SOLID Vestments LLC) to pay for them we can include language in the contract to this effect. Typically, home owners make us (SOLID Vestments LLC) responsible for minor things like mowing the lawn and basic interior or exterior maintenance. However, we are open to doing major repairs, such as replacing the roof or foundation. If you prefer to take care of major repairs yourself, you can set a dollar amount per year in maintenance.

STEP 7: Agree Not To Take ANY LOANS Against the Property

We will want a promise that you won’t do a reverse mortgage or get a home equity line of credit. If you did, then you might lose your home if you default on the loans. In that situation, we will lose out on the chance to buy the house at the end of the term.

STEP 8: Sign the Contract

Your contract won’t be legally binding until we both sign it. Once signed, we distribute a copies and either give the original to a lawyer or store it in a safe place, such as a safety deposit box.
